SUMMARY OF DUTIES AND RESPONSIBLITIES
Claim Representative, Staff Claim Analyst
Responsible to investigate, evaluate and handle to disposition by settlement, trial or arbitration, serious and complex personal injury, contractual, property damage liability and subrogation claims. This involved determination of contractual obligations, liability and theories of defense. Collaborate with assigned counsel with respect to discovery, trial, and arbitration. In select circumstances represent company in arbitration hearings.
Position required expertise in the knowledge and application of Law of Comparative Negligence; liability evaluation including knowledge of case law and statutes. This required understanding of Law of Contracts including coverage determination; determine need for solicit and assess opinions of counsel in contract interpretation. Processing and investigation required understanding of procedural law including suit handling; knowledge of Rules of Civil Procedure, and litigation management; injury and damage specification, evaluation and settlement.
Other responsibilities include assisting counsel in expert and percipient witness selection and assessment. This included assessing need for and obtaining expert witnesses in pertinent cases including medicine, accounting, economics, and cause-origin. Further responsibilities included attending trials and hearings on motions and depositions, as well as, assisting counsel in preparing questions of lay and expert witnesses. On occasion, testifying at trial as to claim procedures, investigation and processing.
Formulate and prepare technical reports for use of company personnel and counsel.
This position was responsible for entire bodily injury operation in Southern Nevada. Duties included assessment of functioning of claim operation in terms of compliance with Fair Claims Practice Act. Planning and budgeting of allocated and unallocated expenses. Develop and implement new plans and procedures. Negotiate contracts with outside counsel regarding fee arrangements. Understand and monitor Law of Policy Interpretation, Tort Law, and Law of Remedies. Monitor jury trends and statutory law and mentoring of new and experienced claim personnel.
Responsible for line management of 5 to 10 bodily injury claim representatives. Responsibilities included salary administration, recruitment and hiring of employees, and supervising, training, and motivating employees in bodily injury units. Position required expertise in various areas of law including, policy interpretation and torts as well as skills in motivation, participative management, team building, and social support.
Assure consistency and objectivity in evaluations by reviewing and recommending settlement amounts on files. Transfer technical expertise through coaching and training of others. Assist management creating strategies to address injury severity through review and on-going analysis of settlement data. Review work content, quality of others. Provide settlement or expense authorization to others.
Advanced/Expert knowledge; includes medical review systems, trial process, ADR, claim department procedure, regulatory compliance, Fraud/Special Investigation Unit practices. Colossus reporting system, basic contracts, coverage analysis, evidence gathering, medical report interpretation, general insurance, knowledge, injury value calculation methodology.
Director of Liability Claims - York Claims Service of Nevada, Inc.
The Director was responsible for the establishment of an automobile claims handling operation of third party administrator in Nevada. Included hiring and management of clerical and claims professionals. The Director designed job functions, preparing budgets, quality reviews, marketing of services, assuring compliance with Unfair Claim Practices and administrative laws and regulations of Nevada.
District Coordinator, State of Nevada - Insurance Educational Association
Responsible to market, identify instructors, locations for educational activities. Give group and public presentations. Assist with the development of educational programs and their market. Establish insurance educational programs in Nevada. Report to Vice-President in New Port Beach California.
Insurance Consultant - Forensic Insurance
Review, research and provide opinions as to property and casualty insurance and processes. Opine as to the application of standards and protocol to insurance products and benefits. Provide litigation support, claims reviews, underwriting assessments. Review Good Faith and Fair Dealing as benefit due in marketing, underwriting and claims handling.
Construction Defect and Structural Product Defect Specialist-ADDECO
Responsible to open, manage, evaluate, negotiate and dispose of a large pending of construction defect and product liability claims by settlement or trial. Responsibilities included assessing the application of Coverage under ISO and manuscript forms and endorsements. Assess, apply and resolve Indemnity and Additional Insured claims. Give direction to and assign independent adjusters in the investigation of defect claims. Represent the company in mediations, mandatory settlement conferences. Coordinate and recommend course of action and discovery to assigned counsel. Assess evidence as to cause-effect, damages under the law of Nevada.
